Our Statute Is Based On Risk

The U.S. Food and Drug Administration are alerting consumers about cosmetic products recalled due to the presence of asbestos. On March 5, 2019 the FDA issued a Safety Alert warning consumers not to use certain Claire’s products. Last week both Beauty Plus and Claire recalled their respected products, and consumers who have these batches/Lots of Claire’s or Beauty Plus products should stop using them. As we indicated in our March Statement, the FDA needs these conclusions and our responsibility to safeguard consumers really. These results are part in our ongoing review of aesthetic products for asbestos and our dedication to take regulatory and enforcement action as needed.

The FDA will continue steadily to update its Safety Alert with new information as it becomes available. Day Each, cosmetic products are sold to consumers across the U.S. 18, still in the formative years of development. These products being used within daily beauty and cleansing routines, quite often on the skin’s most sensitive areas, like the real face, eyelids, and lips.

That’s why it’s so important that cosmetic products are safe, labeled, and free from contamination properly. It’s also why whenever we hear about reports of contamination, like the 2017 reports of asbestos contamination using cosmetic products sold by Claire’s and Justice retailers, we’re especially concerned. Today, we’re providing an update on our diagnosis of the contaminated Claire and Justice products. This consists of the release of new unbiased tests results and an associated safeness alert that warn consumers against the use of certain makeup products sold by Claire’s.

We’re also announcing new steps that the FDA is taking, given existing disadvantages on our cosmetic oversight authority, to raised ensure the safe practices of the cosmetic products men, every day women and children use. Our goal is to help ensure the safety of the products that consumers use and pursue steps that modernize our quest for that mission.

The makeup products industry is having rapid growth and innovation. These obvious changes help bring new opportunities and decisions to consumers. There are now more types of cosmetic products open to consumers than ever before. But they can alsobring new uncertainty, complexity and risks. But at the same time, when it comes to cosmetics, our authority hasn’t changed in a long time even as the industry has undergone rapid evolution.

Right now, when it comes to cosmetics, individuals and companies who market these products in the U.S. Which means that ultimately a plastic manufacturer can determine if they’d prefer to test their product for security and enroll it with the FDA. To be clear, there are currently no legal requirements for any cosmetic manufacturer marketing products to American consumers to test their products for safeness. Although the FDA doesn’t have pre-market review authority, there are other tools besides the requirement for agreement that the FDA uses to guarantee the safe marketing of products.

In the case of cosmetic products, the FD&C Act imparts the responsibility on us to screen the makeup products market and do something to safeguard consumers, if needed, in the post-market location. Cosmetics should not be “adulterated” or “misbranded,” indicating they need to be safe for consumers when used according to guidance on the label, or in the customary or expected way, and they must be properly tagged.
